Agreement

These Terms of Use (“Terms”) govern your access to and use of OnlyUp, including:

  • the website https://onlyup.trade (waitlist and related pages)
  • the gated terminal at /app
  • the Android APK distributed via trade.onlyup.app (sideload; not listed on Google Play at this time)

By using OnlyUp, you agree to these Terms. If you do not agree, do not use OnlyUp.

The product

OnlyUp is a Solana-only software interface for viewing and trading memecoins and related market activity (including pump.fun-style lifecycle segments such as new, almost bonded, and migrated). Features may include pulse, tape, wallet views, and PnL tools.

OnlyUp is not:

  • a broker, exchange, custodian, or financial adviser
  • a perpetuals / futures platform
  • a rewards or yield program
  • a multi-chain terminal for BNB, ETH, or other non-Solana assets

Eligibility

You must be at least 18 years old and legally able to use crypto trading software where you live. You are solely responsible for complying with local laws.

Waitlist and access

Joining the waitlist (email and phone) does not guarantee access, features, or any particular launch timeline. We may approve, delay, or revoke access at our discretion.

Wallets, keys, and custody

  • Trading wallets offered or generated through OnlyUp are client-generated and encrypted, and are exportable by you.
  • We do not custody your funds and do not take control of your seed phrases.
  • External wallets (for example Phantom, Solflare, Backpack) are used for deposits you confirm in those wallets. Confirmation flows are not skipped, and those integrations do not extract seeds.
  • You are solely responsible for safeguarding devices, backups, exports, and recovery phrases. Loss of keys can mean permanent loss of assets.

Blockchain and third parties

Solana transactions are public and irreversible once confirmed. OnlyUp relies on third-party networks, RPCs, token programs, and sites such as pump.fun-related infrastructure that we do not control. Outages, forks, congestion, or third-party failures may affect the product.

High risk — no guarantees

Cryptocurrency and memecoins are extremely volatile and speculative. You can lose some or all of any funds you use.

Nothing in OnlyUp is financial, investment, legal, or tax advice.
We do not guarantee profits, price performance, uptime, accurate token data, or successful trades.
Past activity shown in pulse, tape, or PnL views is not a promise of future results.

You use OnlyUp at your own risk.

Acceptable use

You agree not to:

  • use OnlyUp for unlawful activity, sanctions evasion, fraud, or market manipulation
  • attempt to break, scrape abusively, or disrupt OnlyUp infrastructure
  • reverse engineer the service except where allowed by law
  • misrepresent your identity to gain access
  • interfere with other users’ wallets or sessions

We may suspend or terminate access if we believe you violated these Terms or create risk for the service or other users.

APK / sideload software

The Android build at trade.onlyup.app is distributed outside Google Play. You are responsible for how you install and trust sideloaded software, keeping the app updated, and understanding device security risks.

Intellectual property

OnlyUp branding, UI, and software are owned by us or our licensors. You get a limited, revocable, non-exclusive license to use OnlyUp for its intended purpose. You may not copy, resell, or exploit the product except as allowed in writing.

Disclaimers

ONLYUP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THE ACCURACY OF MARKET, TOKEN, OR WALLET DATA.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST KEYS, OR LOST CRYPTO ASSETS, ARISING FROM YOUR USE OF ONLYUP OR INABILITY TO USE IT.

OUR TOTAL LIABILITY FOR CLAIMS RELATING TO ONLYUP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), OR THE AMOUNT YOU PAID US FOR ONLYUP IN THE THREE MONTHS BEFORE THE CLAIM (IF ANY), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.

Indemnity

You agree to indemnify and hold us harmless from claims arising out of your use of OnlyUp, your trading activity, your violation of these Terms, or your violation of law, to the extent permitted by law.

Changes

We may change OnlyUp features and these Terms. We will update the “Last updated” date when Terms change. Continued use after changes means you accept them.

Governing law

These Terms are governed by the laws of the State of New York, USA, excluding conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in New York, unless applicable law requires otherwise.
